Abstract: De accepta aut accipienda civitate tria in fundamentis posita sunt exemplaria. Unum ex hellenica consuetudine eductum in hac sequentia conficitur: iustitia – confectio normarum – acta. Alium, more romano instructum est et sequentiam ipsam invertit: acta – confectio normarum – iustitia, ita ut, sequentia invertita, sensus iustitiae mutetur et empirice accipiatur. Tertium autem exemplar ab illis duobus ortum videtur et precipue in saeculo luminum constitutum, cuius sequentia est: confectio normarum – iustitia – acta. To address open legal problems on the citizenship three structural models are proposed. The first is from the Greek tradition and founded on abstract principles of justice (justice – production onrules – facts and actions); the second is from Roman tradition and reverses in empirical sense the order: facts and actions – production of rules – justice. The third is derived from the previous and adopted by the Enlightenment tradition.
